Attorney Adam VanHo represented three individuals in Summit and Portage counties on appeals who had their sentences overturned. Our firm was able to take cases that were argued by other attorneys and firms and obtain new sentencing proceedings in all three cases.
In State v. Reuben Clay, a case on appeal from the Portage County Municipal Court, Attorney VanHo was able to secure a new sentencing hearing for an individual convicted of Operating a Vehicle Under the Influence of Alcohol or Drugs. The Eleventh District Court of Appeals has ordered the client to be resentenced -- but he will not face a lower penalty that he had originally be facing.
In another case before the Eleventh District, Attorney VanHo was able to secure a new sentencing hearing for Operating a Vehicle Under the Influence. In State v. Joseph Englehart, the Eleventh District also ordered our client's case to be remanded to the Portage County Municipal Court for a new sentencing hearing due to issues with the sentence the Court imposed.
In Summit County, the Ohio Ninth District Court of Appeals reversed the sentence of one of our clients for the trial court improperly advising the client of his post-conviction requirements. In State v. Jacob Edelen, the Summit County Court of Common Pleas was reversed and ordered to conduct a new sentencing proceeding for sex and drug related offenses.
